Workshop Consent Form and Confidentiality Agreement

This applies to any Connect dinner, Immerse workshop, or Cohort you register for. Registering for a Workshop means you’ve read and agree to this document.

Purpose and Nature of the Workshop

A Workshop is a facilitated group experience designed to support personal and professional growth in a supportive setting. Workshops are conducted by certified coaches or licensed providers acting in their role as Workshop facilitators ("Workshop Facilitators").

A Cohort consists of a series of weekly or biweekly sessions held over an 8-10 week period with the same group of participants. Registering for a Workshop is a commitment to participate in all scheduled sessions associated with that Workshop.

Confidentiality and Sharing of Information

Workshops take place in a group setting in which participants may discuss personal information and experiences. By participating, you understand and agree that:

Workshop Facilitators may take notes or prepare summaries to support the Workshop and maintain continuity between sessions.

Notes and summaries may be shared only with other Workshop Facilitators assigned to your Workshop and an authorized Malu Journey representative acting as the program administrator (the "Program Administrator"), solely as reasonably necessary to facilitate the Workshop and maintain continuity.

Notes and summaries will avoid identifying or attributing a comment to a particular participant. Malu Journey will obtain your separate consent before sharing a note, comment, story, or insight in a manner that identifies you, except where disclosure is required by law or reasonably necessary to address an immediate safety concern.

You may hear personal experiences, challenges, or insights shared by other participants. You agree to keep confidential all information that identifies or could reasonably identify another participant, including names, occupations, personal stories, contact information, and similar details.

You may apply general lessons from the Workshop to your own personal development, provided that you do not identify another participant or disclose another participant's personal information or story outside the Workshop.

Your confidentiality obligation does not prevent you from reporting unlawful conduct, seeking professional or legal support, responding to a valid legal requirement, or reporting an immediate threat to the safety of yourself or another person. When doing so, you should disclose only the information reasonably necessary for that purpose.

Zoom Recording, Transcription, and AI-Assisted Notetaking

If disclosed during registration for the applicable Workshop, Malu Journey may use Zoom's audio or video recording, transcription, or AI-assisted notetaking features to create recordings or written summaries that support participant learning, Workshop quality, and continuity between sessions.

Zoom processes the audio, video, and transcription information needed to provide these features. Within Malu Journey, recordings, transcripts, and summaries are accessible only to authorized Workshop Facilitators and the Program Administrator, except that a Workshop summary or recording may be made available to participants in the same Workshop when appropriate and disclosed as part of the Workshop.

Recordings, transcripts, and summaries are not used for marketing or research and are not publicly distributed. They are retained only for as long as reasonably necessary for the purposes described in this Agreement and are then deleted or de-identified in accordance with Malu Journey's retention practices, except where a longer period is required by law.

Malu Journey will obtain separate consent before using an identifiable participant statement, image, audio, video, story, or other Workshop content for any purpose not described in this Agreement.

Workshop Materials

You may receive documents, guides, templates, recordings, or other materials as part of a Workshop ("Workshop Materials"). Workshop Materials are owned by Malu Journey or its licensors and are provided solely for your personal, noncommercial use. You may not copy, reproduce, distribute, publish, sell, or share Workshop Materials except with Malu Journey's prior written permission.

Workshop Materials do not include the personal information, stories, or contributions of other participants, which remain subject to the confidentiality obligations in this Agreement regardless of how you receive them.

Attendance, Cancellations, and Refunds

Workshop schedules are established in advance, and Workshop Facilitators, venues, and vendors are arranged based on confirmed registrations. Workshop fees are non-refundable if you cancel, discontinue participation, or miss a Workshop or any session within a Workshop. Make-up sessions are not available.

If Malu Journey cancels or reschedules a Workshop, the remedies described in the Cancellation and Refund Policy in the Malu Journey Terms and Conditions will apply.

Educational Purpose; No Healthcare Relationship

Malu Journey is not a healthcare provider and does not provide medical or healthcare advice, diagnosis, or treatment. Workshops are informational and educational, are not a substitute for professional mental-health or medical services, and do not create a therapist-client, doctor-patient, or other healthcare-provider relationship between you and Malu Journey or between you and a Workshop Facilitator in connection with the Workshop.

If you are experiencing an emergency, are considering harming yourself or another person, or believe another person may be in danger, contact local emergency services and the appropriate authorities immediately. Do not rely on a Workshop, Workshop Facilitator, or the Malu Journey Platform for emergency assistance.

Acknowledgment of Group Confidentiality Risk

All participants are required to respect the confidentiality obligations in this Agreement. However, Malu Journey cannot guarantee that another participant will comply with those obligations. By participating, you acknowledge the inherent risk that another participant may improperly disclose information shared during a Workshop.

To the fullest extent permitted by law, you voluntarily waive and release Malu Journey, its affiliates, directors, officers, employees, contractors, and agents from claims, liabilities, damages, or losses arising out of or relating to your participation in a Workshop, including a breach of confidentiality by another participant or reliance on information presented during a Workshop. Nothing in this Agreement waives a right or remedy that cannot lawfully be waived.

Additional Agreements

This Agreement supplements the Malu Journey Terms and Conditions and Privacy Policy, which also apply to your use of the Platform and participation in a Workshop. If a Workshop registration page contains additional terms specific to that Workshop, those terms also apply. If there is a direct conflict concerning the Workshop, the more specific Workshop term will control to the extent of that conflict, except where applicable law requires otherwise.

Consent and Acceptance

By accepting this Agreement and registering for a Workshop, you acknowledge that you have read and agree to this Agreement, the Malu Journey Terms and Conditions, and the Malu Journey Privacy Policy; consent to participating in a group setting in which personal experiences may be discussed; consent to the creation and limited sharing of de-identified Workshop notes and summaries as described above; when recording, transcription, or AI-assisted notetaking is disclosed for the Workshop, consent to Malu Journey's use of the disclosed Zoom features as described above; agree to protect the confidentiality of other participants; agree to use Workshop Materials only as permitted above; and acknowledge the Workshop attendance, cancellation, and refund terms.
